The federal records search includes all criminal, civil and bankruptcy courts within the federal court system. The search results include felony records and other related activity on file with the federal courts. Remember the federal search includes criminal, civil and bankruptcy records all in one online search. The criminal background record portion of this background check includes felony convictions and other related activity captured on the court record itself. We attempt to go back 7 years with our Federal Court Records Search, but there are currently four courts that do not allow us to go back seven years. These 4 Federal Courts are the New York Southern Bankruptcy Court – which only goes back to April 2009, Indiana Southern District Court – which only goes back to February 2007, the US Court of Appeals, Second Circuit – which only goes back to January 2010 and the US Court of Appeals, Eleventh Circuit – which only goes back to January 2010. These Federal Courts account for only 1% of the Federal Courts we search and there are well over 300 Federal Courts which means that the vast majority go back at least seven years. There is nothing EvictionRecords.com can do to pull at least 7 years worth of data from these four courts because we have no control over their policies and each Federal Court determines how far back they make records and files available for retrieval.
Each Federal court maintains its own case information on file; therefore, variations in date ranges between jurisdictions occur. However, almost all of the Federal Courts allow us to go back at least 7 years, which we do. Each Federal Court / Jurisdiction dictates how they store records, how long they store them for and how long they make them available for retrieval. This is why we can only attempt to go back at least 7 years with our Federal Court Records Search. The only way you would not get at least a 7 year Federal Court Records Search is if the records sought are located at one of the four Federal Courts listed above that do not allow us to pull records from the past 7 years. In which case we would pull records as far back as they allow as listed above and return those records to you our customer.
NOTE: If a federal case has been filed against an individual, and there is an open warrant out for that individual it would be included provided that the case is not sealed until service of the indictment, which sometimes occurs in federal court.
The federal search will also return arrest warrants and cases awaiting trial including “failure to appear” charges.
